Part I Disclaimer
This software is free for you to use
You may enjoy the warranties, conditions, and terms that Zhihang Da ‘ai (Henan) Technology Co., Ltd. (hereinafter referred to as “Zhihang Da’ ai”) is not permitted to exclude or restrict under applicable laws. Except for these non-exclusive warranties, conditions, and terms, the Software, Zhihang Da ‘ai Online Services, and third-party online services are provided “as is.” Zhihang Da’ ai and its suppliers make no warranties, conditions, representations, guarantees, or terms (whether express or implied, whether based on statutory law, common law, practice, custom, or any other basis), including but not limited to performance, results, security, non-infringement, marketability, integrity, uninterrupted use, quality satisfaction, or suitability for any special purpose. This disclaimer of warranties may be invalid in certain jurisdictions. You may retain the rights to warranties that cannot be waived or excluded under applicable laws. Zhihang Da’ai shall not restrict your rights to warranties beyond what is permitted by applicable laws.
The aforementioned liability exclusions and limitations shall remain valid within the maximum permissible scope of applicable law, even if remedial measures fail to take effect. Zhihang Da Ai does not provide support services for this software.
Part II Software License Agreement
1. Definition.
“Software” means the software referred to above, including all media and documentation associated with the Software. The term “Software” also includes all future software updates (“Updates”) that are not provided to you under separate terms.
2. Software license.
If you obtained this software from Zhihang Da Ai or its authorized licensees, you may use the software as described in the documentation and for the purposes specified therein, provided you comply with all terms of this agreement. If the software is designed to be used with another Zhihang Da Ai-issued application software product (“Primary Program”) and you hold a valid license from Zhihang Da Ai to use the Primary Program, Zhihang Da Ai grants you a non-exclusive license to use this software with the Primary Program. Except as otherwise provided below, you may use such software in accordance with the terms and conditions of the Primary Program End User License Agreement provided by Zhihang Da Ai.
3. Intellectual property.
Zhihang Da Ai and its suppliers hold all intellectual property rights of this software. This software is non-commercial and is licensed exclusively for use. Installation, copying, or use of this software in any other manner is strictly prohibited except as expressly permitted. Zhihang Da Ai and its suppliers reserve all other rights not expressly granted under this agreement.

4. Update.
By using the updated version, you voluntarily waive all rights to any previous versions of this software. Zhihang Da Ai may send updates to you under different terms. This software may automatically connect your computer to the Internet to check for updates that can be downloaded to your computer. For information about changing default update settings, please refer to the software documentation.
5. Internet access and online services.
5.1 Automatic Internet Connection. This software may automatically connect your computer to the Internet, notifying you that Zhihang Da ‘ai Software has been successfully installed and that you are using Zhihang Da’ ai and other services provided by the company. For information on changing default settings, please refer to the software documentation. The following rules apply to all automatic Internet connections provided by the software.
5.1.1 When this software automatically connects to the Internet, it will send the Internet Protocol address related to your current connection to the Zhihang Da Ai website.
5.1.2 When the Software automatically connects to the Internet, it does not send any personally identifiable information, unless the Internet protocol address is also considered personally identifiable information in certain jurisdictions.
5.2 Third-Party Online Services. This software enables you to access websites and services provided by third parties (“Third-Party Online Services”). Your use of such services is governed by their respective terms and conditions. Zhihang Da Ai reserves the right to modify or discontinue any Third-Party Online Services for any reason. Zhihang Da Ai neither controls nor supports these services, nor does it assume any liability for them. All transactions involving Third-Party Online Services—including their privacy policies, the use of your personal information, product/service delivery, payment arrangements, and any related terms—are solely between you and the respective third parties.
6. Disclaimer.
This software is free for you to use.
You shall be entitled to all warranties, conditions, and terms and clauses provided by Zhihang Da Ai under applicable law. You acknowledge that Zhihang Da Ai makes no express warranties regarding the Software, and that the Software is provided “as is” without any warranties of any kind. Zhihang Da Ai makes no express or implied warranties, including but not limited to warranties of fitness for a particular purpose, merchantability, or non-infringement of third-party rights. The foregoing exclusions and limitations shall be valid to the maximum extent permitted by applicable law, even if remedial measures prove ineffective. Zhihang Da Ai shall not provide support services for the Software.
7. Liability Limitation
7.1 Except for any compensation expressly prohibited or restricted by law, Zhihang Da Ai, its affiliates, and suppliers shall not be liable under any circumstances for any losses, damages, claims, or expenses, including indirect, consequential, or incidental losses, lost profits or savings, or damages arising from business interruption, personal injury, failure to fulfill care obligations, or third-party claims, even if Zhihang Da Ai representatives have been notified of the possibility of such losses, damages, claims, or expenses.
7.2 Under no circumstances shall the aggregate liability or other liabilities assumed by Zhihang Da Ai, its affiliates, and suppliers under this Agreement or related agreements be limited to the amount paid for the purchase of this Software (if any). This limitation shall remain in effect even in the event of material or serious breach of this Agreement or violation of its material or essential terms. The provisions of this Agreement shall not limit liability for death or personal injury resulting from negligence or fraud (scam) by Zhihang Da Ai. Zhihang Da Ai, on behalf of its affiliates and suppliers, disclaims, excludes, and limits its obligations, warranties, and liabilities, but does not act on behalf of others or for other purposes.
7.3 The Zhihang Da Ai APP provides access to flight records. Users may consult these records to assist in locating the aircraft, but such records cannot serve as grounds for claims against Zhihang Da Ai or its affiliates.
The aforementioned limitations and exclusions may apply only where permitted by applicable law in your jurisdiction. These limitations may be invalid in certain jurisdictions. You may have non-transferable rights under consumer protection laws and other applicable laws. Zhihang Da Ai shall not restrict your rights to warranty or compensation beyond what is permitted by applicable law.
8. General provisions.
If you fail to comply with the terms of this Agreement, your rights to use the Software shall terminate immediately. Any provision in this Agreement deemed unenforceable shall be interpreted in its entirety and in the narrowest possible scope, while the remaining provisions shall remain valid and enforceable. Article 8 shall continue to be effective after the termination of this Agreement. This Agreement shall not prejudice any consumer’s statutory rights. Any amendments to this Agreement must be executed in writing by authorized representatives of Zhihang Da Ai to take effect. This Agreement constitutes the definitive agreement between Zhihang Da Ai and you regarding the Software, superseding all prior statements, discussions, commitments, communications, or promotional materials related to the Software.
